Avoiding trademark trouble

When a trademark or copyright owner contacts us about a suspected violation, we investigate and pull apps when the complaint is valid. Lately we’ve been doing more of this, especially for trademark misuse. Sometimes the requests come from the owners of big, well-known brands. Other times they come from new brands. Either way, we often find trademark violations are unintentional: some developers just aren’t clear on what constitutes a violation. But these investigations—and the time and money they can cost—can be avoided by doing a little homework before submitting or updating your app.

Keeping the quality bar high

First, we’re seeing developers submit the same app to multiple Marketplace categories, a violation of our policies. Instead, you should pick a single category that best reflects the content and function of your app. This not only helps customers find your app but gives all developers an equal opportunity to have their app discovered where people expect. Developers who submit the same app across multiple categories will have it removed from the catalog.

Second, when you create multiple closely-related apps—say, a series of quote apps that vary by theme—the Marketplace tile images must reflect the unique features of each individual app. They cannot be duplicates or near duplicates of each other. Your branding also shouldn’t dominate the tile.

Cleaning up keywords

Starting this week, we’re going to start enforcing the five keyword rule for all current and future Marketplace apps. Any app that exceeds this number will have all its keywords deleted. Affected developers will be notified and can then enter five new keywords in App Hub. We’re taking this action to help ensure that customers are able to find the most relevant set of apps for their search—including yours.

Refining our approach to content policy enforcement

The final issue I want to discuss is one that affects all major app stores today: the treatment of apps that are “racy” or sexual in nature. We’re committed to offering a diverse selection of safe and quality apps that appeal to a wide range of customer interests. Items that some customers view as entertainment, others may consider inappropriate. This is a challenge for any big retailer, whether they operate online or down the street.

The latter product will be a key test for Microsoft when it launches later this year.  The company faces the uneviable task of fulfilling conflicting objectives — delivering a crisp, innovative experience suitable for tablets and desktops alike, while at the same time maintaining or improving on the core traditional desktop experience.

I. A Bullish Surprise

Whether Microsoft will rise sufficiently to the occasion remains to be seen, but the calendar Q1 2012 (fiscal Q3 2012) earnings reported late yesterday afternoon by Microsoft give cause for optimism.
Microsoft’s core money-makers — Windows 7, Xbox 360, SQL Server/System Center, and Office 2010 — all posted impressive numbers.  As a result Microsoft posted revenue of $17.41B USD and a net profit of $5.11B USD ($0.60 USD per share).  The revenue was up 6 percent from last year, but profits were down one cent per share from last year, thanks in part to Microsoft’s heavy spending.

But the key thing is that Microsoft blew past analyst expectations of revenue $17.176B USD and net profit of $0.5748 USD per share.  In fact, Microsoft’s earnings nearly matched the most bullish of analyst estimates.

Windows 7 continues its meteoric rise as the world’s fastest growing operating system in history, claiming a 40 percent market share.  Sales rose to $4.62B USD, up 4 percent from last year.  SQL Server and System Center followed in suit, with the former growing by “double digits” and the latter growing 20 percent.  Overall the server division raked in 14 percent more than last year, for a total of $4.57B USD.  Office 2010 sales continued strong, driving $5.81B USD in revenue — a 9 percent increase.

II. Outlook
Two big questions face Microsoft — how to reinvent the winners (Windows, Office, Xbox) and how to salvage the losers (Bing, Windows Phone).

In the winners department, Microsoft is rumored to be preparing the Xbox 360’s successor for a fall 2013 launch.  Code-named Durango, rumor has it that Microsoft is handing out development kits based on a 16-core PowerPC architecture central processing unit from International Business Machines, Inc. and a Radeon 7000 series card from Advanced Micro Devices, Inc. (AMD).  The device will need all that power; it is supposed to launch alongside a next generation Kinect (Kinect 2), which will be capable of tracking users’ movements down to their fingertips.

In the losers department, Microsoft is starting to make headway with Windows Phone 7.  After seeing some sales success at last with its launch of the Lumia 900 LTE and device maker Nokia Oyj. (HEX:NOK1V) on AT&T, Inc.’s (T) network, Microsoft received a boost on Wednesday during Verizon’s earnings call.

Fran Shammo, CFO and EVP of Verizon Wireless – a joint venture between Verizon Communications Inc. (VZ) and Vodafone Group Plc. (LON:VOD — called Microsoft a key “third ecosystem” that his company hopes to cultivate.

He comments, “I do think, though, it is important that there is a third ecosystem that is brought into the mix here, and we are fully supportive of that with Microsoft. And as we said that we created the Android platform from beginning, and it is an incredible platform today that we helped create, and we are looking to do the same thing with a third ecosystem. So that is how I think that we plan to go into the future here.”

Netflix has been a supporter of Windows Phone since it first launched in 2010. Netflix released the first version of its Windows Phone app in October of that year. Yesterday, the company released a major 2.0 update for the app and is available now in the Windows Phone Marketplace.

The major new addition is that Windows Phone owners in the UK, Ireland and 47 countries in Latin America can now stream their local selection of movies and TV shows from Netflix to their device. Netflix expanded to those territories for PC, iOS and Android owners in 2011. Those same users will also noticed that the app’s user interface has been localized for their appropriate counties and languages.

The 2.0 version of the Windows Phone Netflix app also has finally added support for subtitles and closed captions for the movies and TV shows that support those features. There’s also new support for alternative audio tracks in the new version in case you want to listen to a video in another language.

Finally, Netflix says that the 2.0 version of the Windows Phone app has some unspecified performance improvements and optimizations. Hopefully, that means users will be able to have a smoother and faster experience running videos and browsing Netflix’s library of streaming video titles.

On Friday night, Nokia had sponsored a concert by singer Nicki Minaj in New York City’s Times Square to promote the launch of the 900. There were electronic displays, free “Lumia Light” cocktails, and other promotions. But, according to news reports, on the actual day of the launch, Sunday, virtually all of the 39 AT&T stores near Times Square were closed or did not answer phone calls, while others did not yet have the 900 in stock.

‘A Mistake’

The Easter Sunday launch has been getting a thumbs-down from many industry observers, especially since the 900 is considered critical to the success of the Windows Phone 7 platform and the alliance between Nokia and Microsoft.

We asked Avi Greengart, an analyst with Current Analysis, why the companies would launch on such a big holiday. He said that the holiday is the start of AT&T’s spring promotional campaign, and “Sundays are when the stores generally change over their promotions.”

But, Greengart said, “it was a mistake to launch on Easter, and they should have waited” until Monday, adding that it is “too early to tell” if the U.S. launch will be successful.

As for the phone’s competitive advantages against a crowded field that includes hit devices running on Apple’s iOS and Google’s Android, Greengart praised the industrial design of the 900, whose machined polycarbonate shell “looks and feels like nothing else on the market.”

‘The App Gap’

The phone also differentiates itself in the new Windows Phone 7’s interface. Greengart said he expected that the interface’s hubs, live-data tiles, and other unique features will be appealing to many potential users.

But the Phone 7 platform will need to ramp up available apps, given what Greengart called “the app gap.” While there are tens of thousands of apps now available for Phone 7 devices, he pointed out, there are “hundreds of thousands” for competitors’ phones.

As part of its promotional effort, and to emphasize the efficiency of its Phone 7 platform, Microsoft has set up “free-time machines” in New York, San Francisco, and Chicago, from which users can obtain free offers of meals, personal shoppers, cleaning, dog walking and other daily tasks.

Reports on online sales have indicated the 900 is selling comparatively well, driven at least in part by its $99.99 price. As of Monday, the 900 models in black and cyan were first and third, respectively, on Amazon’s list of best-selling phones with service plans.

But a possible wrinkle in the rollout is a report of problems in connecting the 900 to a data network. Some users are complaining that the issue occurs not on first use, but occasionally on subsequent ones.

Microsoft has earlier hinted at releasing Windows Phone 7 devices meant for the Chinese market this March. The release is said to include China-specific customizations such as the use of Tencent Weibo and QQ services in lieu of Twitter and Facebook (which are banned in the mainland). Reports say a definite release date is set, with HTC launching the Triumph on March 21, and Nokia launching its Lumia smartphones by March 28.

HTC actually beat Nokia to the punch by announcing the launch of the HTC Triumph — known as the HTC Titan in the U.S. — and selling the device at pre-order since earlier this week. Now, Nokia CEO Stephen Elop has announced March 28 to be the definite date of their Lumia launch in the country.

No specifics have been announced, although TechCrunch speculates that these will include the entry-level Lumia 610, and a China-specific Lumia 800 and Lumia  719C. These will be CDMA variants, which will support China’s varied 3G standards, including China Mobile’s TD-SCDMA.

China Telecom has announced plans to carry the Nokia Lumia Windows Phone 7 handsets by launch date. Forbes estimates pricing to be at US$ 68.45 or about 20% above market price.

China Telecom currently has about 39 million 3G users, which is a smaller user base compared with China Mobile’s 54 million and China Unicom’s 43 million. But at 14% 3G penetration rate, the country’s mobile networks still have enough room to grow, in terms of converting 2G users to 3G. China has already surpassed 1 billion mobile subscribes, although most of these are using slower 2G networks.

By supporting all of China’s major mobile networks, Microsoft hopes to get a headstart in the market, with Apple’s iPhone 4S only supporting China Telecom and China Unicom. The iPhone 4S currently doesn’t support China Mobile’s 3G network, although Apple is reportedly working on a variant that will work on TD-SCDMA.
